Landlord then sent us an ILLEGAL notice of eviction and instruction to vacate the property in less than 20 days and to turn over the keys to their ex-step father in law....and this was when Char was going to be in for her open-heart surgery... and have been harassing us ever since...via their agents assigned for inspection and oversight of the property, our landscaping lights have been cut 7 times... legally posted No trespassing signs have been torn down repeatedly, harassment and nuisance calls have been made against us to the Sheriff's Department, someone spiked the lower radiator hose on our car, now our only car... as we sold the other two... and it was known that it was now our only vehicle.. and I have been physically assaulted in the middle of the street by 2 of the landlord's agents. the stress impacted and reduced Char's recovery from her surgery, and the stress re-elevated her stroke symptoms...and she had to be re-admitted to the hospital because of it... My Blood Pressure from the stress and drama jumped to 193/111 and the Dr.s wanted to admit me to the hospital for emergency treatment, which at this point is a no-can-do... as I am Char's 24/7 surrogate care giver... so the put me on hydrochlorothyazide, atenelol, and clonidine... and ordered over 9 labs to be done which cost me over $500... I am now required to take my BP a minimum of 3 times daily, and adjust my medications accordingly... and I have a follow up with my Dr. on the 31st... for evaluation of the labs, possible prescribing of new and additional meds... or even admission for inpatient treatment. So our little paradise here.... turned into hell on earth.... and we have now leased a little 2 bedroom apartment in Palm Bay... and filed the paperwork with the County for the illegal attempted eviction by the Landlord, and all of his violations and refusal to abide by FL landlord/tenant statutes... we were in no way in violation of our lease, listed properties for the landlords on our forums, approved tenants for them, and inspected and maintained their properties for them.... but since they go caught with their pants down.. they have attempted to get us out of here, before all of the violations and ecological nightmares were reported and acted upon by Federal, State, County, and local authorities... too late... Joined: April 2008 Posts: 498 | We do have an attorney already on retainer, and his specialty and area of expertise and practice is landlord/tenant disputes... and he is one of our freecyclers who like me, and another couple of members rebuild old computer systems and give them away to families who either do not have a home computer, or need a secondary system to keep the kids off of mom and dads' system.. We do NEED an attorney or process server in Idaho, where the Landlord's now reside... in Hope ID. anyone know of an attorney in Idaho? that would be willing to serve the papers for us? I'm sure there's a "service" in Idaho that can do it. If it's like NY, and if personal service is the same, NY let's you do it by mail, though the out of state defendant has to sign and return an acknowledgement. So you could try that. It has to be sent first class mail, not priority, not certified, just first class. You can ask the pro se clerk at your local court house. You might be able to get a form at a local legal supply store because it may have to be served by a non-party. The store may even have some advice for you under Florida law, if it involves something in Florida. So check with the pro se clerk and the local legal supply store. If those don't work, and it has to be personal, then, you just have to pay someone to go up to the guys door, and affix the summons and complaint to the door, and then he puts a copy in the mail to defendant. (at least in NY) The server then sends you an affidavit of service, and you're off to the races. If it's small claims (under 5000), I'm pretty sure in NY you can mail it. Good luck. | ||
