This is another auction where the seller doesn't use a reserve but states that he'll end the auction if he doesn't get what he wants for the item.

I didn't think you were allowed to do that?.....

....Smells like a "Hector" to me.

Seller can end the auction at any time he wants to. I've done it myself. Nobody can force you to sell something against your will. Sure if you are interested in something and it disappears you're going to be disappointed, but that's life. If you wanted it bad enough you would have made the guy a sweet offer already. It's no different than putting your car out in front of your house with a "for sale" sign on it, somebody looks at it and is kind of interested but when they show up the next day to check it out again you tell them you changed your mind and it's off the block. I bid on this when it was on eBay a couple of months back. I believe it went for over $2K. This seller in France is not the seller from before, so either it's a quick flip or it's a scam.

I thought that if you put an item on ebay (or any auction) with no reserve that you "agreeing" to sell it to the highest bidder no matter what the item brings.
If a bidder wins an auction,he's "legally bound" to uphold his end of the contract and pay for the item......Isn't the seller also "legally bound" to sell the item he put up for sell to the winning bidder?

I don't beleive it's right to bid on an "no reserve" auction and win (after 6+ days) just so the seller can say...."Oh! I'm sorry,I want MORE for my item that what you bid so I'm pulling it"

The guy selling his car in front of his house is selling for a set price (reserve?) He states what he'll take and either you want it or not, unless he has a sign in the window saying "For Bids"....

The feeBay analog to that scenario would be the 'Buy It Now' listing with the 'Make An Offer' option. I've thought about running one that way, but whenever I've listed anything, I never seem to remember that it's available.

That's only after the auction comes to completion. Prior to completion there is no agreement. I think ebay stipulates that you can't pull the auction within the last 24 hours, but up until that time the seller is free to pull it for any or no reason.

The car analogy is that I've got a car sitting in front of my house with "For Sale $5000." on it. A guy comes to the door with 5k in his hand. "I don't want to sell it". "But you have to, it says For Sale on it". "No I don't". "Why not". "Because I want $7000 for it". "But it says $5000." "So what" ...

Maybe I'm the odd duck here, but I see no problem with cancelling auctions early if that's what the seller wants to do. It's HIS guitar, and we have NO rights to it UNTIL we win the auction. Now, to have someone WIN an auction and then refuse to sell it to them like asswipe hector did, THAT is against ebay rules and against any common decency. At least I hold myself to a higher standard.

historically, sellers are protected more than buyers, even in legally binding contracts, even when they refuse to sell. That's just the way it is.

This guitar will be too expensive for my budget...
The seller bought it 01-OCTOBER FOR 1999$!

It's a very interesting guitar for its beauty and its history.

Dave,I agree with you :cool: that the seller can end his auction early if he wants to. My comments were prematurely aimed at the seller. (auction is still open)

I jumped the gun in assuming that the seller is planning to "pull a Hector" at the close of the auction by thinking his disclaimer statement gives him the "right" to refuse to sell to the winning bidder 'cause he didn't get what he wanted for the guitar or he had a better offer.......We'll find out in roughly 6 days!

It is a beautiful guitar and I hope that Jerome wins it! :D

Bill, I still can't figure out how you got your hand through that hole to write on that label.
Dantzig must be an OK guy if he races vintage Porsches. His racing website doesn't look too active lately, though.
