There was an auction on ebay last weekend for 47RI serial #16 and #38.

The seller said in the auction, "This guitar was on hold for someone originally, who unfortunately decided not to follow through and take it home. Therefore, this incredible low-numbered guitar is now available and still BRAND-NEW, with full lifetime warranty...I am a licensed dealer's Northwest sales rep for these...Please note again that this guitar is NEW...with full warranty..."

I almost took #16 in lieu of one of two that I had on order with the same Ovation Dealer.

But considering the early number of the guitar, I had to wonder where has #16 been all this time?

In one email, the Dealer wrote, "...and when these came available, I didn't even think about it, the guys that had tem back out, and so we put them on the market...if you want them, you can have them and I will wait to sell the last serial numbers."

Then in a subsequent email, the Dealer wrote, "The two that I now have are new guitars out of my stock taken back as legitimist store returns."

The following is what the Dealer wrote to an OFC member, "We'll see what he wants to do...number 16 has no certificates with it....didn't have them when it came in. Both of these have been sold, but have come back to me from the guys that bought them, you know both of them actually, but not that they had these guitars....they want the one I am building now...no record of the sale, and neither has been played for more than an hour, so I can I consider them floor stock and sell as new. It's a loop hole, and considering the guys that had these, I'm comfortable doing that. Bruce is not going to be happy that he gets no certificate with number 16...."

Full warranty refers to the Original Retail Purchaser.
The Dealer conveniently has no record of the sale.

47RI #16 has been out there for some time now.
If #16 was returned, it was not from Over-Night-Buyer's-Remorse... someone has had it for a while.

The way it looks to me, is that the guys who originally bought #16 and #38 returned them for "Store Credit" towards custom guitars the Dealer is having built.

Shameful that a Dealer can be so unethical...

but I am thankful that one of you guys had my six covered.

I had promised myself that I would invest no more time on this issue. However, no record of the sale and no loss of warranty. Incredibly
interesting statements. And, this sham was about to be foisted on a fellow OFC'er and my friend.

Seems that both the IRS and Kaman would be interested in the above statement. Assuming the dealer took cash, check, or credit card, there would be a record of the sale.

"you know both of them actually" - must be OFC'ers. Maybe they can clarify why this wouldn't void the warranty. If there is no warranty as pre-owned, then false statement on the eBay auction.

Personally, we have seen extreme behavior concerning the 47RI. We have always had OFC'ers make special orders through whoever they wanted. We have OFC'ers come on to tell us they got an LX from a dealer like Music123. Good for them.

When an OFC'er is being mistreated, a dealer violating his contract - we MUST let the others know.

This is serious...we would rather be involved in talking about guitars...this dealer has continued to claim, charge, infer. If anyone has a different opinion, fine. However, this is my opinion.

My post did not speak of mistreatment.

I said I almost bought a guitar and another OFC'er helped out with the facilitation of making an informed decision.

To me, the information was priceless. I was surprised by the admissions of the Dealer and what unfolded over the weekend.

No problem, Noah. if you guys believe a dealer is violating their contract, seems you should be talking to Kaman, not 5000 people who aren't in a position to do anything about it.

Sometimes discretion is the better part of valor. This particular dealer has been the center of considerable controversy around here. Why drudge all that up and sour the waters here again and again?

You could simply have said, "I have concerns about #47-RI numbers 16 and 38 which are on the market. PM me if you are considering purchasing them."

That way, people who have a stake in it can contact you directly and the rest of us who just want all this OFC/dealer crap to blow away can ignore it.

As Miles said in the manifesto thread, "Why some people just can't leave a subject alone is beyond me."

And, Tony, as you yourself said in that same thread, "I think it is time to move on..."

I see nothing wrong with alerting fellow OFC members about potentially shady ebay deals. Just make sure it's based on facts. In this case the the dealers own communications seems to spell out the facts in black and white. Dave

I haven't had any intention or desire of posting back on here and will not respond again, but obviously there are those that now question my integrity here.

Most of you know me, some of you know me very well. My integrity and honor has not ever been called into question, nor should it be now. Take it for what you will, but you will not see my name attached to anything shady or bogus. Misunderstandings happen, but NOTHING I've done is below-board. Period. I've bought and sold personally on the OFC and well over 100 items on ebay, and even given money to "charity" projects
done by OFC members. If there's an honest concern about me personally or my ethics, for some unknown reason, it would only seem prudent and fair to address it directly, wouldn't it? Like adults?

All my info is still here, including my email. Obviously my ebay name is the same, so anyone who actually believes there is a problem or has an issue is welcome and able to address me privately and directly. There's no point in festering more of the same old crap here.

Please return to your regularly scheduled programming...
