Boston, MA (March 17, 2011)––The trial resulting from the lawsuit filed by Andover-based Fishman Transducers, Inc. on January 17, 2007 against Esteban, Daystar Productions, and HSN Interactive, LLC, started Monday in the United States District Court for the District of Massachusetts.

The lawsuit is for unfair competition, trademark infringement, and false advertising in violation of the Federal Lanham Act.

Fishman alleges in its complaint that Esteban, Daystar, and HSN advertised, promoted, and sold Esteban guitars while stating that the Esteban guitars were equipped with Fishman electronic components. According to the lawsuit, these statements have been made in television infomercials as well as on websites.

Fishman claims it has sold no electronic components to Esteban or any other party for use in Esteban guitars, and that it has not authorized either Esteban or Daystar to use the name and trademark "Fishman" in promoting and selling Esteban guitars.

Larry Fishman, president of Fishman Transducers, stated, "We have worked hard for many years to establish a position as a leading manufacturer of the highest-quality products. We are obviously very concerned by the blatant misconduct of the defendants identified in our complaint, and we intend to protect our good name and trademarks vigorously."

Chris Martin, CEO of CF Martin Guitars, will be testifying for Fishman as the trial progresses.

Whatever happened to that Estoban guitar world tour and video that was being put together ... I remember doing a segment when I was in Amelia a few years back.

Speaking of which ...

I think Matt's safe ... there was no pickup in that guitar. And it's true what they say about great players making even crappy guitars sound good ...

Yeah for Fishman. There's a Fishman bridge PU on the VXT and it is terrific.

"And furthermore, we at Fishman in no way encouraged Esteban to put our electronics in a cardboard guitar."

(I got a Fishman in my Indonesian Parker P-36)

Esteban should have included those cool shades and Hat, so even if you couldnt make the guitar sound good you would look good playing it.

In the brief filed by the Esteban lawyers. "It was a simple mistake made by the printers. Esteban intended to say "equipped with Pocket Fisherman, not Fishman Pickup"

Looks like their lawyers are as genuine as their Fishman pickups.

I remember seeing Esteban when we were staying at some resort in Scottsdale, before this whole guitar thing came out. I wasn't wow'd. I mean, he was good, but I thought he was just a regional hit. How he managed to get 300 million dupes to buy his crappy guitars is a true wonder.

He was selling dreams, not guitars. That's why he was so successful. it's what people really want to buy.

I've played with a friend who has an early 60's Gibson Dove. He bought a very fancy Esteban nylon classical guitar. He was very happy with it and it was only a few hundred bucks. Esteban's crappy guitars are no crappier than other crappy guitars.

It'll be interesting to see how this turns out. Seems to me that the complaint has more to do with Larry Fishman not wanting his name associated with Esteban ... I don't see anywhere in the complaints where it is alleged that Esteban actually lied about using Fishman components. Since this case has gone to trial, there's obviously more than meets the eye and we're only getting one side of the story ... Stephen Paul (Esteban) etal remain mum while Fishman are issuing Press Releases that seem ego-driven to me.
