There is an ad running in CT for a health care outfit of some sort....named Ovation.

Is the name still registered/trademarked to Ovation Instruments New Hartford CT or can any new start up simply take the name as its own?

Trademarks are generally restricted to the industry in which the company operates. Duplicate names are allowed where there is unlikely to be any confusion. There is also an Ovation that makes horse saddles and tack.

Hence Apple computers were taken to court by Apple music and told to stay out of the music business. Then they just took over the music business and it took years (and lots of lawyers) for Beatles music to appear on iTunes.
