Hector, if my mouth is dirty it's because you put a bad taste in it. You made a contract on ebay, then you broke it. To top it off, you posted negative feedback on somebody who was unfortunate enough to have won your auction, not realizing that he was dealing with a dishonorable person. Negative feedback can't be erased and now he's stuck with it and will have to explain it every time he does business on ebay.

The people on this website are like a family Hec. And you would have been welcome. But not after you tool people around and play games.

That clean enough and plain enough for you Hector?

Hec ol' boy, I go to a church that says love thy neighbor as thyself, not screw everybody because one or two people have screwed me.

I think most people here would be willing to overlook the ebay contract issue but when you deliberately leave negative feedback for somebody who wins your auction and you won't sell, well, that's just plain nasty.

As for you being in control, well, I suspect that nobody here would want to do business with you. So good luck with your "control".

Let me get this straight. Hector tried to screw people, and it bit him in the butt, and now he got screwed by giving bank account info etc and lost bids ... mmmh. Well that's alright. Hec, did you even have the guitar to begin with? Reading all this crap makes me wonder, and quite thankful that Serge didn't loose any money. Honesty and full disclosure, and not double dealing is a lot better then being a crumb chaser after a buck.

Hector, With all due respect I fail to see how YOU are the one who was wronged. You turn this around like YOU have been screwed or persecuted in some way. The fact it is that if you had no intention to sell to the high bidder, all YOU had to do was cancel the auction just before it ended. But YOU didn't. YOU screwed up. Even after the auction, if you did not want to sell the guitar to Serge, all you had to do was say so. But for some insane reason YOU had to leave him negative feedback. Again YOU are the one who fucked up, not anyone else. As far as offers like 12,000 outside of ebay, nobody can control that. If YOU believed the offers, then that is YOUR fault, nobody elses. You have a nice guitar that many people would love to own. Unfortunately YOU have shit the bed so badly that nobody will sleep with you. The problem is facing YOU right in the mirror.

this is my first posting on this item.. but I can't hold back.

If this thing happened to me on German ebay hector would receive a letter from my lawyer (and as I have an insurance I wouldn't pay anything for the lawyer)

I think there are two different aspects:

- if someone is bidding outside of ebay... he just breaks ebay rules.. and maybe can banned from ebay if someone really cares about it

- if anybody (in this case hector) starts an ebay auction and the auction is finished, there is a legal contract between seller and high bidder. And the high bidder has the right to receive the guitar in this case. (I had one ebay seller who could not deliever the item he had offered.. therefore he had to pay back not only the money I had paid to him, but also the difference that I had to buy to organize it somewhere else....)

all the confusion about the first auction (closed by ebay) and the resulting bids outside of ebay is just hectors fault, but the result was: no contract out of the first auction... maybe breaking some ebay rules, but who cares about, as there are no real consequences
but the 2nd auction has a legal contract as result....

the negative feedback hector left just characterizes himself... it does not need more comments on this

hope my english is not too bad to understand.... but I really couldn't keep quiet...

Hector, as one eBay seller to another, if you should ever sell another guitar on eBay, the proper way to get maximum money while protecting yourself is to either start the bidding at the minimum money value you will accept, or put a reserve at that value and start it lower.

Then do NOT listen to offers outside the auction, force them to bid. If they are serious, they will. I've done fine with either approach.

There is no way to cheap out eBay---they will get their cut, they've designed it that way. Your approach to selling this guitar was guaranteed to cause hard feelings.

Best wishes for an equitable settlement of this. Serge is a good and honorable person, from everything I have seen here.

Serge, the only way I would buy anything from this asshole is to fly over to TX, see the guitar and if it checks out give him the dough, I certainly would not send him a penny. Having watched this whole sorry episode pan out, I'd trust this charlatan about as far as I could spit a dead rat.

Hector, with absolutely no respect, why didn't you just bite the bullet and pay the few bucks for ebay's reserve fee. Then everyone wouldn't think you were a total c*"t.
It's pretty simple, if it doesn't meet the reserve then the market tells you you're asking too much. Purely as a piece of "expeditionary marketing" the reserve fee on $15K is not unreasonable.

Maybe we can let it lie till Serge gets or doesn't, the guitar. Once that is settled then let the trashing begin. I think Segre has a way to have the guitar procured with one hand on the money and the other on the guitar.

Actually sent Hector a very nice email this evening hoping that the little limp lizard would negotiate honorably with Serge and we could move on. From what I understand, he is pining for a French or Japanese savior to save the day. He wants more than, from what I understand, any of this series have sold for. Good luck, maybe Osama needs one to play while hiding in his cave.

This knave, double-talking scoundrel, cretin, Marielitos, Medusa's spawn has the right to sell it to anyone he pleases. However, I doubt if anyone wants to be tainted by his acquaintance. His stench purmeates and overwhelms...would probably have to fumigate the guitar and case.

I believe this guitar soap opera is over. And didn't say one untrue or #&$@# word.

Personally, I believe Serge should have his attorney file to enjoin Hernandez from selling the guitar.

What gets me is that he impugns the manhood of the people here and then refuses to live up to HIS responsibility. The rules are that he HAS to sell the guitar to Serge at the price the auction ends at. I've had many auctions end at a price lower than what I wanted, but I was legally and morally bound to sell at that price, tough luck for me.

Hector, manhood is living up to your responsibilites, not deciding which of them you want to bother with, and skating away on the rest. I hope this can be ended equitably, but my belief is that it should be Serge's guitar at the price the auction ended at. Nothing else.
